Marc D. Powers has been practicing securities regulation, litigation and enforcement law for over 25 years since leaving the SEC's Enforcement Division and leads BakerHostetler's Hedge Fund Industry practice and Securities Litigation and Regulatory Enforcement practice from its New York office. During his career Mr. Powers has provided compliance and regulatory advice to hedge funds, fund of funds, mutual funds and family offices, their principals, portfolio managers and employees, and has represented them in disputes in litigation and arbitrations nationwide. Marc's broad experience addresses each client's circumstance individually, providing proactive support throughout all aspects of a fund's operation, from inception to regulatory compliance to unavoidable litigations.
He has successfully represented clients in SEC, CFTC and criminal investigations and proceedings against charges of misleading fund valuations, accounting irregularities and restatements, insider trading, misappropriation, market timing and late trading, supervisory failures and futures market manipulation. He is a member of BakerHostetler's National Task Force on Complex Financial Fraud and is ranked by Chambers for his Securities Litigation expertise. Mr. Powers is a sought after commentator on many complex securities-related issues, appearing on panels, in print media and television, and is a regular contributor to various industry publications.
